TERMS OF SERVICE

1. About these terms

These terms apply to consumer purchases made through the Wine Chateau online store. By placing an order, you agree to these terms. They do not affect your statutory rights.

Wine Chateau is operated by Wine Chateau Ltd, a company registered in England and Wales under company number 13516122.

1. Consumer and trade orders

These terms apply to consumers purchasing for personal use.

Wholesale and other business purchases are governed by our Trade Account Terms of Supply.

Consumer retail prices include VAT at 20%. Approved trade customers see trade prices excluding VAT alongside the VAT-inclusive retail RRP. Trade purchases are governed by our Trade Account Terms of Supply.

1. Age restrictions

You must be aged 18 or over to order alcohol or book an event involving alcohol. You must not purchase alcohol for anyone under 18.

We operate Challenge 25. Anyone who appears under 25 will be asked for accepted photographic ID proving they are aged 18 or over – at our shop, when collecting an order, at delivery or at an age-restricted event.

We may refuse or cancel an order where age-verification requirements are not satisfied or where we reasonably suspect proxy purchasing, fraud, unlawful activity or inaccurate information.

1. Products and availability

We take reasonable care to describe products accurately. Bottle design, packaging, vintage and colour may occasionally vary from photographs when a producer updates its presentation or a vintage changes. Mileștii Mici wines are supplied only in the fixed vintage stated on the product page. We will not substitute another vintage; if that vintage is unavailable, we will contact you to arrange a refund or an alternative with your agreement.

We will not make a material product substitution without your agreement.

If an item becomes unavailable after you place an order, we will contact you and offer an appropriate alternative or refund the unavailable item.

1. Orders and acceptance

When you place an order, you are offering to purchase the selected products.

An automated order acknowledgement confirms that we received your order. It does not necessarily mean that we have accepted it.

For goods, a contract is formed when we confirm dispatch or that the order is ready for collection. For tasting events, your booking is accepted when we send the order confirmation email, which is your booking confirmation; no separate ticket is issued.

We may reject or cancel an order before acceptance because of unavailable stock, an obvious pricing or description error, failed payment, suspected fraud, delivery restrictions or legal and licensing requirements.

If payment has already been taken for a rejected or cancelled order, we will refund the affected amount.

1. Prices and payment

Retail prices are stated in pounds sterling and include VAT where applicable.

Delivery charges and the final order total will be shown before you complete checkout.

You must use a payment method that you are authorised to use.

If an obvious pricing error occurs and you could reasonably have recognised the error, we may cancel the affected item and issue a refund.

Promotional codes and special offers are subject to their stated conditions, availability and expiry dates. They cannot be exchanged for cash.

1. Delivery

We deliver only to the locations offered during checkout.

Delivery services, charges and estimated delivery dates are shown before payment and explained on our Delivery Information page.

Unless a different delivery period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is made.

You are responsible for providing a complete and accurate delivery address and ensuring that an adult aged 18 or over is available to receive alcohol.

Alcohol will not be left unattended or in a nominated safe place.

Reasonable return or redelivery costs caused by incorrect customer information, an unavailable adult recipient or failure to provide acceptable age identification may be charged or deducted from a refund where permitted by law.

Goods become your responsibility when they are delivered to you, delivered to a person identified by you or collected from our shop. Ownership passes once we receive payment in full.

1. Collection

Collection is available only when offered during checkout.

Please wait until we confirm that your order is ready before travelling to the shop.

The person collecting an alcohol order must be aged 18 or over and may be required to provide acceptable identification, the order confirmation and evidence that they are authorised to collect the order.

1. Cancellation, returns and refunds

Your rights to cancel an online order, return eligible goods and receive a refund are explained in our Returns & Refunds Policy.

For most online retail purchases, you may notify us that you wish to cancel within 14 days after receiving the goods. You must then return the goods within a further 14 days.

The statutory 14-day cancellation right does not apply to leisure services, including tasting events, booked for a specific date or period. Our event cancellation policy applies instead. Any other exclusion will be explained before purchase and will apply only where permitted by law. Your rights concerning faulty or misdescribed goods are unaffected.

Nothing in these terms limits your rights where goods are faulty, damaged, not as described or otherwise fail to meet legal requirements.

1. Events and tastings

Event tickets and tasting bookings are also subject to the description and conditions displayed on the relevant event page.

Guests must comply with age-verification, venue, safety and responsible-service requirements.

We may refuse admission or alcohol service where reasonably necessary for legal, licensing or safety reasons.

If Wine Chateau cancels an event, we will offer a refund or an appropriate alternative.

We may make reasonable changes to event content, wines, speakers or timings where those changes do not materially alter the advertised experience.

1. Our responsibility

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable, business losses arising from a consumer purchase, or delays and failures caused by events outside our reasonable control where we have taken reasonable steps to minimise their effect.

Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory consumer rights.

1. Website use and customer accounts

You must provide accurate information and keep your customer-account credentials secure.

You are responsible for activity carried out through your account unless that activity was caused by our failure to keep the service secure.

You must not misuse the website, interfere with its operation, attempt unauthorised access or use its content unlawfully.

Website content, Wine Chateau branding, photographs and text belong to Wine Chateau Ltd or their respective licensors and may not be commercially reproduced without permission.

1. Personal information

We process personal information as described in our Privacy Policy.

Shopify and our payment, delivery and service providers may process information where necessary to operate the store, fulfil orders and comply with legal obligations.

1. Changes to these terms

We may update these terms to reflect changes in the law, our services or our business operations.

The terms displayed when you place an order will apply to that order.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

1. Governing law

These terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you retain any mandatory legal protections available to you and may bring proceedings in the courts applicable to where you live.

1. Complaints and alternative dispute resolution

If you are dissatisfied with an order, product or service, please contact us at support@winechateau.co.uk, telephone 07493 217324, or write to our Towcester trading address. Please provide your order number and a clear description of the issue.

We aim to acknowledge complaints within two working days and provide a final response within 14 calendar days. If additional time is reasonably required because a matter is unusually complex, we will explain why and keep you updated.

Wine Chateau is not currently required to participate in an alternative dispute resolution (ADR) scheme and does not currently subscribe to one. If an ADR scheme or another dispute-resolution arrangement becomes available to you because we are legally or contractually required to participate, we will provide the relevant information when communicating the outcome of your complaint.
